Acceptance and account
You must be legally able to enter an agreement and must provide accurate information needed to create and secure your account. You may explore, complete the questionnaire, and generate a prototype preview without an account. Account verification and acceptance of the then-current Terms and Privacy Notice are required before a source-package download or paid checkout.
You are responsible for activity conducted through your account and for maintaining access to the authentication method you use.
The $0 basic activation
The basic activation has no platform charge and includes one autonomously generated and validated static website within the approved basic boundary, zero user-requested revisions or regenerations, and up to three successful downloads of the same released package. Failed, interrupted, denied, or expired download attempts do not count.
The first release is intended to conform to the finalized questionnaire. Objective platform defects are addressed through pre-release platform remediation, not a customer revision. A new design expression, changed finalized requirement, additional site, maintenance task, migration task, managed hosting, or other post-finalization work requires an advanced activation.
Domains, hosting, form endpoints, and third-party services may impose separate charges and terms. Basic publication is performed by you using the source and implementation guide.
Your content and uploaded images
You retain all rights you already hold in names, marks, copy, images, files, and other material you submit. You represent that you own or have sufficient permission to provide and publish that material and that your instructions and content are lawful.
Trade Momentum receives no ownership or continuing license in your uploaded images. You provide only the temporary, purpose-limited permission needed to process an image at your direction to generate, validate, package, and deliver your site. Trade Momentum will not use customer uploads for model training, marketing, advertising, sale, profiling, portfolios, product showcases, or unrelated internal purposes.
Generated output and intellectual property
Trade Momentum retains all right, title, and interest in A New System, the generator, platform, application logic, orchestration, reusable templates, policies, adapters, proprietary components, and Knockout EDA. Those systems are not sold or assigned to you.
Upon the first authorized basic download, Trade Momentum grants you a perpetual, worldwide, non-exclusive, royalty-free license to use, copy, host, publish, display, modify, adapt, and distribute the released site-specific output for any lawful purpose and to authorize contractors to do so for you. The license has no scheduled revocation or expiration and is not terminated by download exhaustion or later account deletion.
The site-specific source, generated copy, generated layout, and platform-generated images are licensed, not assigned. No exclusivity or copyright-validity promise is made for purely AI-generated material. Third-party components remain governed by their own terms.
Advanced activations and provider checkout
Advanced frameworks, certified prebuilt applications, additional pages or images, revisions, managed hosting, maintenance, migration, persistent services, integrations, and custom logic require a separately defined activation. Approximate prices shown in the prototype are planning hypotheses, not live offers.
When live purchasing is approved, PayPal-controlled interfaces may process PayPal, eligible Apple Pay, eligible Google Pay, and eligible credit or debit card methods. Stripe-controlled hosted Checkout, Billing, and Invoicing may process card and invoice payments when that rail is selected. Coinbase-controlled checkout may process Base USDC crypto payments. Provider terms govern provider processing. Trade Momentum does not store raw card numbers, security codes, seed phrases, private keys, or raw wallet credentials.
Lawful use and customer responsibility
You may use the delivered site-specific output for any lawful purpose. You may not use the service to violate law, infringe another person’s rights, introduce malicious code, evade access controls, deceive users, or submit content you are not authorized to use.
You are responsible for reviewing the source and content before publication; replacing placeholders; configuring domains, forms, analytics, and third-party services; keeping your own backups; and confirming that your use satisfies laws and industry requirements applicable to you.
Availability and no included operations
The basic source is provided for customer-executed publication. No maintenance, migration, hosting, monitoring, update, domain, legal, tax, accessibility-certification, security-certification, or support service is included unless a written advanced activation expressly says otherwise.
The service and output are provided on an “as is” and “as available” basis to the maximum extent permitted by law. Trade Momentum does not warrant uninterrupted operation, error-free output, business results, search ranking, conversion, fitness for a particular purpose, or compatibility with every provider or third-party service.
Liability limitations
To the maximum extent permitted by applicable law, Trade Momentum will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, revenue, business, goodwill, use, or data; third-party service failure; or a customer’s publication, configuration, content, or use decisions.
No term excludes liability or a consumer right that applicable law does not allow to be excluded. The enforceable aggregate liability cap, governing-law carve-outs, and treatment of a no-charge service must be inserted only after licensed-counsel review; this prototype does not purport to establish those final values.
Indemnity
Subject to applicable law and the final counsel-approved procedure, you agree to defend and indemnify Trade Momentum and its personnel against third-party claims arising from customer-supplied content, your instructions, your unlawful use, or infringement caused by material you supplied. Final terms must define prompt notice, defense control, settlement consent, cooperation, and any consumer or jurisdictional limitations.
Paid cancellations, refunds, and disputes
The $0 basic activation has no purchase price to refund. Paid cancellation and refund rights will be displayed with the exact advanced offer. The intended policy is that a verified successfully published paid deliverable is ordinarily non-refundable, while a pre-publication cancellation, objective platform-attributable failure, or approved rescission may qualify, subject to law and applicable provider, card-network, or crypto-network rules.
Trade Momentum may submit relevant evidence, accept liability, or process an approved refund where technically available, but cannot unilaterally deny a card chargeback or reverse an irreversible on-chain settlement. The applicable provider, issuer, network, or settlement layer controls that outcome.
Account termination and license survival
You may request account deletion subject to lawful record-retention exceptions. Trade Momentum may restrict service access for security, unlawful use, or material breach under the final production terms. Closing an account may end platform re-download availability, but it does not terminate the perpetual license already activated for a received basic package.
General provisions
Electronic acceptance and records may be used. If a provision is unenforceable, it should be narrowed or severed without invalidating the remainder where law permits. No waiver is continuing unless written. Assignment, notice, force-majeure, governing-law, venue, dispute-resolution, and order-of-precedence terms remain to be completed by licensed counsel before commercial launch.
